On March 6, 2008, Wyeth announced that it would appeal the verdict in Donna Scroggin v. Wyeth in the U.S. District Court, Eastern District of Arkansas. The plaintiff sued the manufacturers of Premarin and Prempro relating to her development of breast cancer. On February 25, 2008, the jury awarded the plaintiff $2.75 million in compensatory damages against Wyeth and co-defendant Upjohn. After a second phase of the trial relating to punitive damages, the jury awarded Ms. Scroggin $19.36 million against Wyeth and $7.76 million against Upjohn.
