Florida Jury Rules in Favor of Philip Morris

A jury in Pinellas County Florida has ruled in favor of Big Tobacco in a Engle Progeny lawsuit brought by Mary Gelep, the surviving spouse of former Engle class member Alexander Gelep. The Gelep v. Philip Morris case is the third trial of approximately 8,000 cases filed against Big Tobacco in the Florida court system as a result of a ruling by the Florida Supreme Court in 2006 in the case of Engle v. Liggett Group, Inc. that disbanded a class action of an estimated 700,000 Floridians. This ruling marked a turnaround from two recent Engle Progeny trials in Broward County which resulted in verdicts for the family of Stuart Hess ($8 million award) and Joseph Ferlanti ($720,000 award).

At least 25 tobacco cases are on trial dockets in Ft. Lauderdale, Tampa, and Jacksonville and should go to trial before the end of this year.
